Take a look at these 5 top reasons why this step should be done.<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Validate and confirm the existing owners <\/strong><\/li><\/ol>\n\n\n\n<p>The main reason for performing a title search is to make\nsure that the current owners are actually the people selling the property. It\nwill also show you and your lawyer how many times the property has changed\nowners. This is important because it\u2019s gone through numerous owners in a short\namount of time, that could raise red flags for you. This could mean there has\nbeen suspicious activity that\u2019s been happening at the property. It will also\nshow you who else, if anyone, is on title to the property. Perhaps some distant\ncousin that lives in another country. The property can not be sold without all\nparties being on the agreement. The last thing you want to have happen when\nyou\u2019re in the process of moving in, is to find out someone else is still\nconnected to the cottage and didn\u2019t know it was being sold. &nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Confirms the legal descriptions<\/strong><\/li><\/ul>\n\n\n\n<p>It may sound unimportant but confirming the actual legal\ndescription and the matching PIN associated with the property is an important\nlegal step. Let\u2019s say hypothetically, your realtor made a typo in the original\nPurchase Agreement and there is now an incorrect number or description of the\nproperty that\u2019s gone unnoticed. A simple mistake like this could mean that you actually\ndon\u2019t own that house, you could own the small lot down the road, or nothing, or\nanother property entirely. Asking for a survey of the property is also a great\nway to see for certain that you\u2019re buying what you want to be buying. <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Special easements associated with the\nproperty<\/strong><\/li><\/ul>\n\n\n\n<p>Another way to understand easements is the simplified phrase\n\u201cright of way\u201d. As an example, let\u2019s say your next-door neighbour-to-be ALSO has\nrights to use the driveway beside your property. They use it to access their\nproperty and the main road to get in and out. If the driveway, paved or gravel,\nis between your two homes, it\u2019s quite normal that they have the rights to use\nit just like you. It\u2019s not just your private driveway. You\u2019ll want to find this\nout so you understand you share it with this neighbour. <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Bylaws assigned to the property<\/strong><\/li><\/ul>\n\n\n\n<p>Bylaws, such as let\u2019s say the home has historical\nsignificance associated to it, would mean certain renovations you want to make\naren\u2019t allowed by law. Or, maybe the home is situated in a residential area and\ndoes not allow any commercial use &#8211; so that means you can\u2019t convert part of the\nhome to your business. Are you allowed to divide the lot into 2? Can you rent\nout your basement for a second income? You want to find out about any bylaws before\nyou purchase so there\u2019s no surprises down the road. <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Current liens against the home<\/strong><\/li><\/ul>\n\n\n\n<p>The formal explanation of the word lien is \u201ca right to keep\npossession of property belonging to another person until a debt owed by that\nperson is paid.\u201d Having your lawyer search for any liens will show you any and\nall registered mortgages against the property, as well as who issued it. If an\nundischarged mortgage is discovered, it will need to be discharged (paid)\nbefore you can actually close the deal. Another aspect that could come up is\nthat the Canadian Government has a lien on the property for income tax arrears,\nor child support or any other type of legal judgement.
