{"id":1429,"date":"2019-07-11T15:17:15","date_gmt":"2019-07-11T15:17:15","guid":{"rendered":"https:\/\/areslaw.ca\/parry-sound\/?p=1429"},"modified":"2019-07-11T15:17:21","modified_gmt":"2019-07-11T15:17:21","slug":"boathouse-bylaws-permits-parrysound","status":"publish","type":"post","link":"https:\/\/areslaw.ca\/parry-sound\/boathouse-bylaws-permits-parrysound\/","title":{"rendered":"Boathouse Basics for Cottage Owners"},"content":{"rendered":"\n<p>A cottage boathouse is often so much more than a boathouse.\nIn fact, sometimes its role to house a boat is its least important function!\nFrom being a storage space, party spot, extra bedroom or a cool, shady escape\non a hot day, a boathouse is a multi-purpose must-have for many cottagers.\nHowever, there are also those who aren\u2019t big fans of boathouses, as they can\nobstruct views, affect the wildlife and plant life of the lake, or they can be\n\u2018party central\u2019 for some cottages, potentially upsetting the tranquility and\npeace of the area. <\/p>\n\n\n\n<p>If you are considering a boathouse build or perhaps want to\nrenovate your existing one, we\u2019ve outlined a few tips to help you get started\nso that you are fully prepared as well as fully protected from any legal\nconcerns that may arise. <\/p>\n\n\n\n<p><strong>Permit or no permit? <\/strong><\/p>\n\n\n\n<p>Here are the <a href=\"https:\/\/foca.on.ca\/municipal-authority-over-boathouses-decision\/\">highlights<\/a>\nof the new Public Lands Act as of June, 2017 from the Ministry of Natural\nResources and Forestation (MNRF). Essentially, docks, boat ramps, single storey\nboathouses and other structures are considered to fall within what\u2019s referred\nto as \u2018free use\u2019 of public lands, and don\u2019t require a permit. There are some\nexceptions naturally, and you may require municipal or provincial permits,\nparticularly if a structure touches more than 15 square metres of shore\nlands\/lake bottom or if it\u2019s more than one storey high. Additional permits may\nbe required depending on environmental factors unique to your waterway or land.\n<\/p>\n\n\n\n<p><strong>Permits &amp; by-laws\n<\/strong><\/p>\n\n\n\n<p>If you are planning a new large boathouse build or an\nextensive renovation and need a permit, it\u2019s important to provide surveys,\nblueprints, materials lists, as well as other documents as requested from your\nmunicipal or other authority. <\/p>\n\n\n\n<p>Even if you are within your legal rights to have or build\nyour boathouse, there may be formal or informal complaints about it. In these\ninstances, you can always consult with a real estate legal team who can review\nyour documents and advise you accordingly. <\/p>\n\n\n\n<p><strong>What about restoring\nyour boathouse? <\/strong><\/p>\n\n\n\n<p>For a basic boathouse restoration, a permit is generally not\nrequired if you are maintaining a similar footprint. However, to change up the\nstructure or size over 15 sq. m., or in terms of installing heating, plumbing\nor electrical for example, the usual building permits are required. In the\nParry Sound and Muskoka regions, many boathouses are grandfathered in (also\ncalled legal, non-conforming) and may not be impacted by certain by-laws.
